If you live in a state that does not require you to have an attorney write the purchase agreement, then you may be able to write to offer yourself. However, before you write your offer, make sure that the seller is open to making the deal happen via creative financing. Then, you will be able to put your offer in writing and come up with a win-win situation.

There are many office supply stores that have sample purchase contracts. You can pick them up for as little as a dollar each. Each of the contracts that are sold in the stationary stores are general in nature. So, you want to make sure that the sections written in the purchase agreement do not go against any of your state laws.

The first part of your offer generally deals with having consideration for exchange of the property. It will usually tell you the buyer's legal name, and how the buyer will take title to property.

The second part of the agreement deals with how much you actually pay down for the property. It will also include the terms of a down payment if applicable. This may be if your seller is holding a note for the down payment of a property.

The third part of your offer or usually deals with the terms of the sale. This section shows the total amount offered, the down payment, and the terms for payment of the balance. It also discusses the estimated closing  date and what would happen if either party were to breach the contract.

The fourth part of your offer will give a legal description of the property. This usually tells the property address, the county the property resides in, and the lot size.

The final part simply bears the signature of the buyer and seller.

When both parties agree to the terms of the contract, the final purchase agreement is given to the title company and escrow is opened. The title company will then take the escrow instructions and, based upon the title company's interpretation of the terms and conditions, will have both parties signed the escrow instructions. The only thing to do from this point is to wait for the title company to do their job and have you comment to close the deal.

Make an offer can be a little intimidating at first. But with practice and experience, this daunting task will seem like second nature.
